Terms & Conditions

These Terms of Service (the “Terms”) and our Privacy Policy form a legally binding agreement (the “Agreement”) between you and QualityLife Fitness, LLC (“QualityLife”, “us”, or “we”) and govern your access and use of the training activities, consultations, video demonstrations, webinars, website, content, services and any other materials that QualityLife may provide (collectively, the “QualityLife Services”). If you do not wish to be bound by the Agreement, you may not access or use the QualityLife Services. Additionally, if you are under the age of 18 without written parental consent, you may not access or use the QualityLife Services. 

  1. Amendments. These Terms may be modified, altered, supplemented or amended at any time by QualityLife in its sole and absolute discretion. When modifications are made, QualityLife will update the Terms provided on the website. The “Last Updated” date at the top of the Terms of Service will also be updated. Any amendment to these Terms shall supersede all prior Terms. An amendment to these Terms will be effective immediately for new users of QualityLife Services. An amendment shall be effective for existing users thirty (30) days after it is posted on the website, unless otherwise stated. Your continued use of QualityLife Services after the amendment means that you accept all modifications. Please regularly check the website to view the current terms. 
  2. Limited License.  Subject to your compliance with the Agreement, QualityLife grants you a limited revocable, non-exclusive, non-transferable license to access and use the QualityLife Services in the manner intended by QualityLife. The QualityLife Services are strictly and solely for your personal use and not for commercial use. This license is personal to you and may not be assigned or sublicensed to anyone else. QualityLife reserves the right at all times, for any reason, and without notice to restrict or terminate your license and access to the QualityLife Services. 
  3. Ownership. You acknowledge and agree that any logos, names, designs, text, graphics, software, content, files, materials, and any other intellectual property rights contained herein or otherwise arising from QualityLife Services are owned by QualityLife, its licensors or suppliers. You expressly agree that you will do nothing inconsistent with QualityLife’s ownership of the QualityLife Services, and that you gain no rights, title, or interest in or to any QualityLife Services, except as stated in these Terms or any executed written agreement between you and QualityLife. 
  4. Membership.  To become a member and enjoy full access to the QualityLife Services, you must complete a consultation, a 2020 Par-Q+ Questionnaire, enter into a Membership Agreement and sign a Waiver and Release and Assumption of Risk Agreement. 

Accuracy of Information. To become a member you shall provide current, complete and accurate information as requested. In the event that you provide untrue, inaccurate, incomplete or not current information, QualityLife may terminate this Agreement and your license to access and use QualityLife Services at any time. You are required to complete a 2020 Par-Q+ Questionnaire regarding your medical conditions, which information must be supplemented in the event of any significant change that could affect your safe use of QualityLife Services, and in the event, you provide any incomplete or inaccurate information on the Questionnaire, or otherwise fail to supplement, QualityLife may terminate your membership immediately. 

Eligibility. You represent and warrant that you are least 18 years old and have the right to contract in your own name. You also represent and warrant that you reside in the United States, have not been previously suspended or removed from QualityLife, and you possess the legal right and ability to enter into the Agreement. 

Account Security. You are responsible for all activity that occurs under your account. You are responsible for maintaining the confidentiality of your username and password. Any use of your account by any person other than yourself is grounds for suspension or termination of your account. You agree to promptly notify us of any unauthorized use of your username, password or other account information that you become aware of. QualityLife will not be liable for any loss that you incur as a result of someone else using your password, either with or without your knowledge.

No Show Policy. You agree in the event you need to cancel or reschedule an appointment with QualityLife, you will contact our office no later than 12 hours prior to your scheduled appointment. Any member who fails to show, cancels an appointment, or reschedules an appointment without contacting our office with at least 12 hours’ notice will be considered a “No Show” and forfeits the scheduled appointment. If a third “No Show” occurs QualityLife reserves the right to cancel all future appointments. 

We understand there may be times when an unforeseen emergency occurs and you may not be able to keep your scheduled appointment. If you should experience extenuating circumstances please contact our office, and we may be able to waive the “No Show”. Reservation of Rights. If you are an active member with a “Paid Monthly Membership” pursuant to a Membership Agreement or Corporate Membership Agreement, you will have access to all QualityLife Services. However, QualityLife reserves the right to suspend or terminate your access to the QualityLife Services for any reason or no reason in its sole and absolute discretion. 

  1. User Conduct. You acknowledge and agree that you may only use the QualityLife Services for lawful purposes, and you will not use the QualityLife Services to interfere with others enjoyment of the services. You represent and warrant that you will not (i) circumvent, disable, reverse engineer, decompile, disassemble, or exploit any of the QualityLife Services, (ii) remove identification, warnings, disclaimers, disclosures, or other proprietary notices in or on the QualityLife Services, (iii)  test, disrupt, or interfere with the security of QualityLife Services, servers, accounts, or networks connected to or accessible through QualityLife Services, (iv) access or use QualityLife Services in an unlawful or unauthorized manner, including but not limited to accessing content and data not intended for you, (v) use, alter, copy, modify, store, sell, resell, reproduce, distribute, republish, publicly perform, display, post, transmit, create derivative works of any QualityLife Services, logos, or other proprietary information, without a written agreement between you and QualityLife, and (vi) collect information about other QualityLife members, including email addresses and phone numbers. 
  1. Services. QualityLife has taken reasonable precautions to ensure that all service descriptions, prices and other information shown on the website are accurately described. However, when ordering services through our website, please note that QualityLife reserves the right to not accept any orders or refuse or cancel any order if there are any errors in any information listed on the website or if there are problems related to fraud. QualityLife also reserves the right to refuse, discontinue or change any QualityLife Services at any time in our sole and absolute discretion.

Personal and Payment Information.  You agree to provide true, accurate, current and complete information when you sign up for an offer or purchase any QualityLife Services. By providing any debit or credit card information, you represent that such payment information is correct and belongs to you, or you have the authority to use such card. You are responsible for promptly updating your information with any changes to keep your billing information current.

Term/Memberships. The QualityLife Services are offered on a month-to-month basis. You agree such services will automatically renew, and unless you cancel at least two weeks prior to the automatic renewal date, you authorize us to charge your card for the services in your membership plus any applicable taxes. If you purchased a membership with a free trial period, you authorize us to charge your card when the free trial period ends, unless you cancel your membership before the free trial period ends. You will not receive a notice from us that your free trial period has ended.

  1. Third-Party Services and Content. QualityLife may integrate with third-party websites, platforms, services, applications, tools, interfaces, and content (“Third-Party Services”).  The Third-Party Services may allow you to communicate, submit and upload stories, images, audio, photos, videos, media, chats, and personally identifiable information (“User Generated Content”). You grant QualityLife Services a perpetual, fully paid-up, non-exclusive, sub-licensable, irrevocable and royalty-free license under all intellectual property, copyrights, trademarks, privacy and patents laws to use, reproduce, transmit, print, publish, display, copy, comment on, modify, create derivative works of, make available and otherwise exploit such User Generated Content in whole or in part in any and all media, including but not limited to Facebook, Instagram, and YouTube. 

QualityLife does not review, monitor or control any Third-Party Services, Third-Party advertisements, User Generated Content or any opinions, advice, statements or other information provided therein. QualityLife does not endorse or adopt these Third-Party Services and accepts no responsibility for the quality, content, nature, reliability, or damage resulting from your reliance on the content posted on any Third-Party Services, including those services accessible from QualityLife Services. There is no implied affiliation or endorsement. These Terms are between you and QualityLife only, excluding the Third-Party. You must also comply with all applicable third-party terms of service. QualityLife will not, under any circumstances, be responsible for any loss or damage resulting from your use or reliance on any third-party, the Third-Party Services or its terms. 

  1. Disclaimer of Warranties. You acknowledge and agree that QualityLife Services are provided “as is” and “as available” with all faults, errors and omissions, and without any performance assurances or guarantees of any kind. QUALITYLIFE EXPRESSLY DISCLAIMS ANY AND ALL EXPRESS OR IMPLIED WARRANTIES, CONDITIONS, AND REPRESENTATIONS. QualityLife neither represents, guarantees, nor warrants that the QualityLife Services will meet your requirements, needs or fitness goals, or that the services will be uninterrupted or error-free. You agree to use the QualityLife Services at your sole risk. 
  2. Professional Advice Disclaimer. Although QualityLife provides services with your health and safety in mind, QualityLife is not a healthcare professional. 

Medical Disclaimer.  QualityLife Services do not constitute medical advice, professional healthcare advice, or clinical services. QualityLife Services are provided for informational purposes only, and are not intended to diagnose any medical condition. It is critical that you are truthful and current in your 2020 Par-Q+ Questionnaire, that you consult your physician or other healthcare provider for necessary medical or appropriate care, and obtain appropriate authorization before accessing or using any QualityLife Services. The information made available through QualityLife Services should not be relied upon when making medical or other important healthcare decisions. Your use of any QualityLife Services does not create a doctor-patient, professional-client, or similar relationship between you and QualityLife or any such person working for QualityLife. 

Nutrition. QualityLife provides nutrition plans with our fitness programs. While our nutrition information is designed to safely align with our programs, you must consult with your physician or other licensed healthcare provider before beginning any nutrition plan or altering any dietary regimen. QualityLife Services are not a substitute for professional care or advice. If you have or suspect you have a medical or psychological problem, you should consult your medical doctor or other related professional healthcare provider. 

  1. Assumption of Risk. You acknowledge and agree that you understand the nature of the QualityLife Services, and represent that you are qualified, in good health, and in proper physical and mental condition to access, use and/or participate in the QualityLife Services. You further acknowledge and agree that you are aware that the QualityLife Services will be conducted at your home or in a studio and warrant that if at any time you believe conditions to be unsafe, you will immediately discontinue your participation in the QualityLife Services. You also agree that your participation in the QualityLife Services is completely voluntary in nature.

You FULLY UNDERSTAND that: (a) the QualityLife Services involve risks and dangers of SERIOUS BODILY INJURY, INCLUDING BUT NOT LIMITED TO PERMANENT DISABILITY, PARALYSIS AND DEATH (“Risks”); (b) these Risks and dangers may be caused by your own actions, inactions, the actions or inactions of others participating in the QualityLife Services, the conditions in which the QualityLife Services take place, or THE NEGLIGENCE OF THE RELEASEES DEFINED BELOW; (c) there may be other risks and social and economic losses either not known to you or not readily foreseeable at this time and YOU FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES incurred as a result of your access to, use of, and/or participation in the QualityLife Services. 

YOU HEREBY FULLY AND FOREVER WAIVE, RELEASE, DISCHARGE, COVENANT NOT TO SUE, AND AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS QualityLife, and its administrators, directors, agents, officers, members, volunteers, independent contractors, employees, other participants, any sponsors, advertisers, and if applicable, owners and lessors of premises on which the qualitylife services take place (collectively, the “Releasees”) from any and all claims, ALLEGATIONS, DAMAGES, LOSSES OR LIABILITIES OF EVERY TYPE, WHETHER OR NOT FORESEEABLE, THAT ARE IN ANY WAY RELATED TO OR ARISE FROM THE QUALITYLIFE SERVICES AND/OR CAUSeD OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS.

  1. Arbitration. You and QualityLife (each a “Party” collectively the “Parties”) agree that any dispute, claim or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation or validity thereof or the use of the QualityLife Services (collectively, “Disputes”) will be resolved by binding, individual arbitration governed by the rules of JAMS, unless the rules conflict with these Terms that are in effect at the time the arbitration is initiated.  The Federal Arbitration Act governs the interpretation and enforcement of this section. ARBITRATION MEANS THAT YOU AND QUALITYLIFE HEREBY EXPRESSLY WAIVE YOUR RIGHT TO A JUDGE OR TRIAL BY JURY IN A COURT PROCEEDING. Additionally, discovery and rights to appeal in arbitration are generally more limited than in a lawsuit, and other rights that you and QualityLife would have in court may not be available in arbitration. However, either Party may seek injunctive or other appropriate equitable relief in any U.S. court having jurisdiction to decide on a case involving trade secrets, infringement or misappropriation of that Party’s intellectual property rights.

Dispute Notice. You agree that before initiating any Dispute or arbitration proceeding, you must send a Notice of Dispute (“Notice”) by certified mail to QualityLife Fitness, LLC at 871 Finley Drive, Aurora, Illinois 60504.  In the Notice, you must include your name, address, phone number, the facts giving rise to the Dispute, and the relief requested. If an agreement is not reached between the Parties within sixty (60) days of receipt of the Notice, either Party may commence an arbitration proceeding. Both Parties agree to act in good faith to seek to resolve the Dispute before and during arbitration. 

Class Action Waiver. Both Parties agree that neither will participate in a class action or class-wide arbitration for any claims covered by this agreement to arbitrate. YOU ARE GIVING UP YOUR RIGHT TO PARTICIPATE AS A CLASS REPRESENTATIVE OR CLASS MEMBER ON ANY CLAIM YOU MAY HAVE AGAINST QUALITYLIFE, INCLUDING ANY CONSOLIDATION OF INDIVIDUAL ARBITRATIONS, INCLUDING ANY INITIATED BY ARBITRATORS.  

Time Limitation. You agree that any Dispute arising out of or related to QualityLife Services or your relationship to QualityLife must be filed within one year after such dispute, claim or cause of action arose or be forever barred, regardless of any statute or law to the contrary.

Opt-Out. If you do not wish to be bound by the arbitration and class action waiver provisions in this section, you may elect to opt-out in writing within thirty (30) days of the date that you first use the QualityLife Services or thirty (30) days from the date this section was last updated (unless a longer period is required by applicable law). Your written notification must include your name, mailing address, the email address you used to set up your account, and a statement that you do not wish to resolve disputes with us through arbitration. You must mail your opt-out notice to QualityLife Fitness, LLC at 871 Finley Drive, Aurora, Illinois 60504.  If you do not notify us, you agree to be bound by the arbitration and class-action waiver provisions set out above, including any revisions we make to these Terms.  

Fees. Both Parties’ arbitration fees are set forth in the JAMS Rules for Arbitration of Consumer-Related Disputes. 

Survival. This arbitration section will survive the termination of your relationship with us. If any of the other provisions of this section is found to be unenforceable under applicable law, then such provisions will be null and void and severed from this Agreement.

  1. Indemnification. You agree to indemnify and hold harmless QualityLife and its directors, officers, employees, and agents, from and against all claims, damages, losses and costs that arise from or relate to (i) your use of the QualityLife Services, (ii) any User Generated Content submitted by or on behalf of you; (iii) your violation of the Agreement; or (iv) your violation of any rights of a third-party.
  2. Limitation of Liability. To the fullest extent permitted by law, QualityLife shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including, but not limited to, damages for loss of profits, economic or pure economic losses, goodwill, use, data, service interruption, computer damage, system failure, inability to use the QualityLife Services or other intangible losses, even if a limited remedy set forth herein is found to have failed its essential purpose; and QualityLife’s total liability to you for all claims, in the aggregate, will not exceed the amount actually paid by you to QualityLife over the 12 months preceding the date your first claim(s) arose. You agree that this limitation of liability is reasonable and is a fundamental element of the basis of the bargain between QualityLife and you. QualityLife Services would not be provided without such limitations. 
  3. Force Majeure. Neither Party shall be liable for any failure or delay in performance under these Terms (other than for delay in the payment of money due and payable in accordance with these Terms) for causes beyond the party’s reasonable control and not caused by that party’s fault, or negligence, including, but not limited to, “acts of God”, acts of government, flood, fire, civil unrest, acts of terror, strikes or other labor problems, computer attacks or malicious acts, such as attacks on or through the internet, any internet service provider, telecommunications or hosting facility, but in each case, only if and to the extent that the non-performing Party is without fault in causing such failure or delay, and the failure or delay could not have been prevented by reasonable precautions and measures and cannot reasonably be circumvented by the non-conforming Party through the use of alternate sources, workaround plans, disaster recovery, business continuity measures or other means.  
  4. Governing law. The Agreement shall be governed by and construed in accordance with the laws of the State of Illinois, United States of America, without regard to principles of conflicts of law. Venue for all Disputes and legal actions concerning this Agreement and/or the QualityLife Services that are not required to be arbitrated shall be exclusively in a court of competent jurisdiction in state or federal courts in Cook County, Illinois.
  5. International Users.  QualityLife controls, operates and administers the QualityLife Services within its offices in the United States of America. QualityLife neither represents nor warrants that the QualityLife Services are legally permitted or available for use at locations outside the United States. Accessing QualityLife Services in territories where the QualityLife Services are illegal is prohibited. You may not use the QualityLife Services or export the QualityLife Services in violation of U.S. export laws and regulations. If you access the QualityLife Services from a location outside of the United States, you are solely responsible for compliance with all local laws, rules, regulations, and ordinances. 
  6. Notices. You consent to receive all communications, including but not limited to notices and disclosures, from QualityLife electronically. Notice to you shall be deemed effective and delivered upon the sending of an email to your email address on file. You are solely responsible for ensuring that QualityLife has your current and accurate email at all times and that spam and junk mail settings are properly set to allow emails from QualityLife to reach your inbox. Your notices to QualityLife shall be delivered by U.S. mail, postage prepaid, to QualityLife Fitness at 871 Finley Drive, Aurora, Illinois 60504. Your notice to QualityLife shall be effective upon receipt by QualityLife. For support-related inquiries, you may email support@qualitylifefit.com.
  7. Severability. Each provision of these Terms shall be considered severable, and you agree that if for any reason any provision or provisions herein are determined to be invalid, void, unenforceable or illegal under any existing or future law, such invalidity, unenforceability or illegality will not affect any other term or provision.
  8. Suspension/Termination. QualityLife Fitness reserves the right to terminate or suspend your access and use of any and all QualityLife Services, including but not limited to preventing your access and use of our website. QualityLife Fitness may terminate or suspend its QualityLife Services with or without notice, in its sole and absolute discretion, and for any reason or no reason. You agree that QualityLife shall not be liable for any interruption or termination of your access and use of QualityLife Services.
  9. No Third-Party Beneficiaries. These Terms are between you and QualityLife and you and QualityLife shall be the only parties entitled to enforce these Terms. No third-party shall have any right to enforce these Terms, including any third-party acting on your behalf. 
  10. Waiver. QualityLife may waive any provision of these Terms with or without notice to you in its sole and absolute discretion. However, a waiver of any provision must be in writing signed by a duly authorized representative of QualityLife. In the event a provision is waived, such waiver shall not impair, affect, or waive any other provision. No waiver of any provision of these Terms by us shall be deemed a further or continuing waiver of such provision. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision. 
  11. Assignment. QualityLife may assign in whole or in part these Terms, our rights, and obligations to any person or entity at any time, for any reason, with or without notice to you. You may not sell or assign in whole or in part your right to access or use QualityLife Services or your rights provided in these Terms. 
  12. Entire Agreement. You are in agreement that these Terms, the Privacy Policy, and any other policies referenced herein or posted on the QualityLife website, constitute the final, exclusive and complete agreement between you and QualityLife and supersede all agreements, communications and course of dealings between you and QualityLife Fitness, LLC.  You agree that these Terms are legal, valid and binding, and may be enforced against you. 

QUALITYLIFE PRIVACY POLICY

QualityLife Fitness, LLC (“QualityLife”, “we”, or “us”) respects your privacy and your desire to know how your information is being collected and used. We have adopted this Privacy Policy to explain how QualityLife may collect, use, and share your Personal Information through our website, network, social media account, electronic communications and other services provided by us (collectively, the “QualityLife Services”). This Privacy Policy is a part of and supplements QualityLife’s Terms of Service (“Terms”). By using the QualityLife Services, you are subject to and consent to this Privacy Policy and the Terms, and you consent to the processing of your Personal Information as set forth in this Privacy Policy, as may be amended from time to time. 

  1. Personal Information We May Collect.  QualityLife intends to only collect Personal Information that is relevant to the QualityLife Services. “Personal Information” as used in this Privacy Policy means any identifiable information about an individual. We may collect the following types of Personal Information through the QualityLife Services:

Contact Information. QualityLife collects Personal Information that you provide while communicating with us and using the QualityLife Services. You may provide your name, date of birth, phone number, address, email address, and additional information directly to us when you sign up for a consultation and/or an account. 

Account Information. You may provide a username and password, age, height, weight, injuries, home city or town, profile image, disabilities and medical conditions when you create an account with us and complete our forms, such as the 2020 Par-Q+ Questionnaire.

Fitness Information. We may gather workout history, classes taken and online content viewed, food and nutritional information, and any additional fitness information that you provide through the QualityLife Services. By viewing the videos provided in the QualityLife Services, you agree that QualityLife can track your video viewing history.

Financial Information. You may provide your credit card information and any additional related information when making a purchase or when a payment method is requested to activate a membership. We may also collect data regarding your order history and other transactions you may have completed with us. 

Functionality. We may collect the date and time you access the QualityLife Services, your preferences and your interests to offer enhanced functionality. We may also collect technical information that we may automatically receive when you use our online services, including information regarding the device or browser you used to access the QualityLife Services, such as an IP Address. Technical information may be collected using cookies provided by your device or other similar technologies. 

Third-Party Services. We may receive information about you from third-party services and organizations or social media websites, such as Facebook, that you have made public. We may also collect information about you from messages provided on such third-party platforms and applications by and between you and QualityLife. The third-party organizations may collect information about you and your online activity, and you are subject to their separate privacy policy. We encourage you to read their privacy policies. 

Employment Information. This Privacy Policy does not apply to employees in the employment context. However, we may collect Personal Information that is provided within a job application. We may retain this information after a decision has been made, unless we are asked not to.  Personal Information provided by employees in the application process may be retained in our employee records. This Privacy Policy only applies to employees who elect to use the QualityLife Services. 

  1. The Use of Your Personal Information. QualityLife only intends to use your Personal Information for your benefit and to provide and improve the QualityLife Services. We may also use Personal Information in the following ways:

Services. QualityLife uses Personal Information to generally manage individual accounts, and maintain and administer the QualityLife Services. We may use your Personal Information to customize the QualityLife Services, analyze how you use the QualityLife Services, monitor your performance, and provide you with the information and services we believe will be useful and relevant to you. 

Communications. We may use your Personal Information to communicate with you regarding the QualityLife Services, provide feedback regarding your fitness and wellness, and to provide maintenance support for the QualityLife Services.

Research and Improvements. We may use the Personal Information that we collect to analyze and enhance the effectiveness of the QualityLife Services and to develop new services and products. We may also use Personal Information to create non-identifiable information that we may use to improve the QualityLife Services. 

Marketing. We, or our third-party advertising partners, may use your Personal Information to market and advertise the QualityLife Services, and provide you with promotional materials that may be useful and relevant to you, as permitted by applicable law. QualityLife may provide these materials by phone, mail, text or email, as permitted by applicable law. 

Security. QualityLife uses information to verify identities. We may also use your Personal Information to prevent, investigate and deter harmful and unauthorized illegal activities.

Other Information. We may use your Personal Information for additional purposes described in this Privacy Policy or at the time we gather any additional information. 

  1. Sharing Your Personal Information. QualityLife may share or disclose your Personal Information as provided in this Privacy Policy. We may also share your Personal Information with your express or implied consent. QualityLife tends to share your information in the following instances:

Personal Trainers. QualityLife may share your Personal Information with personal trainers, including, but not limited to, your workout history, answers to the 2020 Par-Q+ Questionnaire, and any other fitness information you provide. 

Service Providers. QualityLife may use your Personal Information to process any payments made for the QualityLife Services. By making any payments for the QualityLife Services, you authorize QualityLife to provide your payment information to payment processors, or any other company acting as billing agents for us, to process all payments, including Vagaro or any other service provider QualityLife so chooses. We may also share your information with third-party advertising partners, delivery companies, and any other service provider QualityLife uses to provide its services, including but not limited to TrueCoach.  

Comply with Legal Requirements. We may disclose your Personal Information as necessary or appropriate to comply with applicable law, respond to lawful requests from governmental authorities, legal processes, to enforce the Terms and this Privacy Policy, and to protect your rights and ours.

Opt-out. You may opt-out of certain uses and disclosures of your Personal Information. If you would like to opt-out, please send a detailed request to support@qualitylifefit.com. If we cannot process your request, we will provide an explanation as to why the request was denied.

Marketing. You can opt-out of receiving promotional emails and text messages from us by unsubscribing as provided in the email or text you receive or by emailing QualityLife at support@qualitylifefit.com. You can opt-out of receiving text messages from us by replying to any text you receive with “STOP”. However, we may still send you updates via email or text that are important to the QualityLife Services as permitted by applicable laws. It may take up to 72 hours for you to be unsubscribed to the marketing communications. 

Account. If you have an account with QualityLife, then you may access and update or correct your Personal Information at any time by logging into your account through our QualityLife Services.  If you believe that there is an error or information is missing and you are not allowed to correct or update the information, please email us at the email address stated below. You may also request access to Personal Information that QualityLife has about you by emailing us at said email.  We will process the request within a reasonable time, and will provide you with copies of the information requested or a summary of the information in our possession. If we cannot process your request, we will provide an explanation as to why the request was denied. QualityLife may charge a fee for any information provided, as permitted by law. 

In the event you want to delete your account, you can email us at the email address below. We may verify that you are the authorized user to the account by asking for Personal Information before we can delete your account. Please note, some information may remain in our possession upon the deletion of your account.

We are not responsible for the content or privacy practices of third parties, and we do not endorse, approve, or review their privacy practices or content. QualityLife takes steps to make sure the information that you provide is secure; however, we cannot warrant and guarantee the security of your information because the Internet is not 100% secure and it is inherently risky. We do not accept liability for any information disclosed unintentionally. By using the QualityLife Services, you agree that QualityLife may communicate with you electronically regarding issues related to security and privacy. 
  1. Children’s Privacy. The QualityLife  Services are not intended for minors under 18 years of age, and we do not intend to collect information from minors under 13 years of age. If you believe we have collected any Personal Information for children under the age of 13 years without the consent of the parent or guardian of the child, please notify us at support@qualitylifefit.com. We will remove the information from our system.

The QualityLife Services are intended for users located within the United States.  We do not warrant or represent that the QualityLife Services are available for use outside of the United States. Accessing the QualityLife Services in countries or territories where the services are illegal, is strictly prohibited. If you are using the QualityLife  Services in countries or territories where the QualityLife Services are legal, then please note that you are agreeing to be governed by the use of your Personal Information in the United States and according to the laws of the United States. Accordingly, your Personal Information may be given to law enforcement agencies and governmental entities in the United States under a court order or other applicable law. By accessing the QualityLife Services and providing your information to the website, you agree that any dispute of privacy or the terms of this policy will be governed by this Privacy Policy and the laws of the State of Illinois.
